ARBITRATION
Good advocacy requires skills. First, Be Organised. Prepare different schedules – a chronology of events from documents/bundles. Don’t let anything slip through the net.
You must have a clear understanding of the sequence of events – the emails/notices under the terms of the contract/shipping documents, the phone calls/meetings + the Statement of Facts.
On completion of the Chronology – here is a tip. Put everything to one side + just look at the sequence. Is there anything that did not happen that should have happened? Not just on the other side – but your side as well. Are there things that have not been spotted? Remember – your opponent should be doing the same so don’t get caught out. Do your quiet time thinking + reflecting. Ask yourself if all this is right? Go back to the terms of the contract – the deadline dates – the exact wording. Do your homework – the Tribunal are relying on you (they shouldn’t but they will), the client is relying on you and the client is paying your fee.
